This is an English translation provided for convenience. In case of discrepancy, the Portuguese version prevails.

This section sets out the conditions for accessing and using this site, its terms and the other legislation in force.

1. PURPOSE OF THE SITE WWW.JAMARKET.PT
On our website we provide information of interest to the customer: the range of products on offer, how to buy them, prices, and the location and opening hours of our stores.

2. CONDITIONS OF ACCESS AND USE
Access to this site is the sole responsibility of users and implies acceptance and knowledge of the legal notices, conditions and terms contained herein. The site www.jamarket.pt does not guarantee that the products and/or services shown here are available in the company's stores, nor that the prices are those in force at the time of consulting the site. JAMARKET reserves the right to make, at any time, such changes to the site as it deems appropriate and/or necessary, without prior notice.

2.1. OBLIGATION TO USE THE WEBSITE AND ITS CONTENT CORRECTLY

The user undertakes to use the website and its features correctly, in accordance with the law, this Legal Notice and the instructions and notices communicated to them.

The user undertakes to use the site and all of its content exclusively for lawful purposes that are not prohibited, that do not infringe the laws in force and/or that are not harmful to the legitimate rights of JAMARKET or any third party, and/or that may cause harm directly or indirectly.

Accordingly, the user shall refrain from using any of the site's content for unlawful purposes or effects, prohibited in this Legal Notice, harmful to the rights and interests of third parties, or that may in any way damage, disable, overload, impair or prevent the normal use of the website, computer equipment or the documents, files and all kinds of content stored on any computer equipment of the company, of other users or of any internet user.

In particular, the user undertakes to respect third-party intellectual and industrial property rights and not to reproduce, copy, distribute, make available, transform or modify the content except where authorised by the rights holder or permitted by law, nor to remove or alter copyright notices and other identifying data.

The use of JAMARKET's photographic and audio/video files is subject to the following conditions: their use for commercial purposes and/or their subsequent distribution is prohibited; they are for the exclusive use of the media for purely informational purposes, provided their source is cited; and their use to illustrate activities, products or events of other companies is prohibited.

Any hyperlink to www.jamarket.pt requires prior authorisation and may not reproduce the site, create a frame over its pages, make false or incorrect statements about JAMARKET, or suggest that JAMARKET has authorised the link or supervised the linking site's services.

2.2. INDUSTRIAL AND INTELLECTUAL PROPERTY RIGHTS

The user is obliged to respect the industrial property rights of JAMARKET and of any other third party. Use of, or access to, the website does not grant any right over the trademarks, trade names or any other distinctive sign used on it. The user may download the website to their device for private, non-commercial use only, and may not exploit, reproduce, modify, publicly communicate, assign or transform the content for public or commercial purposes.

2.3. DURATION OF THE SERVICE

JAMARKET does not guarantee the availability and continuity of the operation of the site, nor its suitability for any specific activity. Where possible, JAMARKET will give advance notice of interruptions. Access has an indefinite duration; however, JAMARKET reserves the right to suspend access, without prior notice, to users who, in its judgement, do not comply with its rules of use, and to take appropriate legal action.

2.4. EXCLUSION OF LIABILITY

JAMARKET makes its best efforts to avoid any error in the website's content but does not guarantee or accept responsibility for possible errors. JAMARKET excludes any liability for damages of any nature arising from: interruption or unavailability of access to the site; privacy and security in the user's use of the site and/or unauthorised access by third parties; the transmission of elements that adversely affect computer systems; and the accuracy, completeness and timeliness of the site's content.

3. USE OF COOKIES

JAMARKET may use cookies to make navigation easier and to recognise the user's preferences. Users may configure their device to accept or reject the cookies they receive. See our Cookie Policy.

4. PROTECTION OF PERSONAL DATA

JAMARKET complies with the legislation in force on the protection of personal data, as set out in the Privacy Policy.

5. GOVERNING LAW AND JURISDICTION

These terms are governed by Portuguese law. Without prejudice to the mandatory rights of consumers — in particular the right to bring proceedings before the court of their domicile and to use alternative dispute resolution bodies — the parties designate the courts of the district of JAMARKET's registered office for any disputes that do not concern consumer relations.

General Conditions of Contract and Use

1. Obligations of customers and users

Customers and users undertake to comply with these General Conditions of Contract and Use, in particular:

  • To refrain from introducing, storing or disseminating through the site any defamatory, obscene, abusive, xenophobic content, or content of any other kind that breaches general principles of law and public order;
  • To keep their login password confidential so as to prevent third parties from accessing their jamarket.pt account;
  • Not to use false identities;
  • To provide accurate personal data and addresses so that JAMARKET can properly process orders.

The customer is responsible for the truthfulness of the data provided to JAMARKET and undertakes to update it promptly in their account at www.jamarket.pt.

2. Product availability
The jamarket.pt catalogue is independent of the physical stores, both in price and in stock quantities. All promotional campaigns have limited stock, exclusively for online sale. JAMARKET only processes an order after confirmation of payment, and therefore cannot guarantee the availability of items until processing begins. JAMARKET ships only on business days; weekends and public holidays are not counted for delivery estimates, which are merely indicative. If a product becomes unavailable, JAMARKET will contact the customer should the delivery time or price change, and the order will only proceed with the customer's consent. In case of absolute unavailability, JAMARKET may propose an equivalent product or, failing agreement, refund the amounts paid within a maximum of 14 days of notifying the cancellation. Any delay relative to the indicative estimates does not entitle the customer to compensation.

3. Cancellations, exchanges and returns
The following conditions apply only to purchases made at www.jamarket.pt.

Right of withdrawal
Having purchased an item at jamarket.pt, you have a period of 14 days from receipt of the order to return it, under the right of withdrawal provided for in Decree-Law no. 24/2014 of 14 February. You may do so provided the following conditions are met:

  • Presentation of the purchase invoice;
  • The product must be returned in the same condition in which it was sold — unscratched, without exterior damage or signs of use and in perfect working order, in its original packaging and accompanied by the user manual and all accessories;
  • Items sealed for hygiene or protection reasons must be returned with the original seal intact.

To do so, the customer may visit any JAMARKET store or contact Customer Support on +351 236 623 129, which will provide all information about the process. The customer must not, under any circumstances, send items to JAMARKET without prior contact, as they will not be accepted.

The following are excluded from the right of withdrawal within the 14-day period: the supply of goods made to the customer's specifications or clearly personalised; goods that by nature cannot be returned or are liable to deteriorate or expire rapidly; sealed goods which are not suitable for return for health-protection or hygiene reasons and were unsealed after delivery; and goods which, after delivery and by their nature, become inseparably mixed with other items.

To exercise the right of withdrawal, the customer must communicate their decision through an unequivocal statement (e.g. a letter by post, fax or email). Where the right is exercised, the customer bears the full cost of returning the goods, except for goods that cannot be returned by normal post, whose direct return costs correspond to the shipping cost table.

Return process
The customer must return the goods without undue delay and at the latest within 14 days of informing JAMARKET of the withdrawal. After contacting Customer Support and receiving return instructions, the item, suitably packaged in its original packaging, may be sent to:

All items are checked on arrival and only those that meet the return conditions will be accepted for exchange or return. The refund is issued via the same payment method or by bank transfer, and only after the condition of the product has been verified. Should you have received damaged or defective items, JAMARKET will arrange collection at no cost to you.

Refunds
In the event of withdrawal, the customer will be refunded the payments made, including delivery costs (except for the supplementary costs arising from choosing a delivery method other than the least expensive standard delivery offered by JAMARKET), without undue delay and within a maximum of 14 days from the date JAMARKET is informed of the decision. JAMARKET may withhold the refund until it has received the returned goods or the customer has provided proof of their dispatch, whichever occurs first.

Refunds for failed delivery
Where an order shipped by JAMARKET is not received after the carrier's delivery attempts and is returned to us, the customer will again bear the delivery costs. If the customer does not agree, the value of the conforming products will be refunded, but not the shipping costs. The same applies where the carrier delivers to a pick-up point and the customer lets the collection deadline pass.

Cancellation of orders
The customer may cancel their order at any time up to delivery, with the right to a refund of the amount paid. Non-payment of the order within 2 days of it being placed results in its automatic cancellation. Under Decree-Law no. 7/2004 of 7 January (on electronic commerce), JAMARKET reserves the right to unilaterally cancel an order where there is a programming error, a malfunction of JAMARKET's systems, or where the contractual offer reaches its destination distorted and the error concerns an essential element of the contract. JAMARKET may also cancel an order due to stock shortages, image or text errors and/or incorrect pricing, in which case it will contact the customer for a mutual agreement or refund.


Legal guarantee of conformity

The consumer goods sold benefit from the legal guarantee of conformity provided for in Decree-Law no. 84/2021, for a period of 3 years from delivery. In the event of a lack of conformity, the consumer is entitled to have conformity restored (repair or replacement), to a price reduction or to termination of the contract, in accordance with the law.

Alternative consumer dispute resolution

In the event of a consumer dispute, the consumer may resort to an alternative dispute resolution (ADR) body. See the competent bodies at consumidor.gov.pt and the European online dispute resolution platform at ec.europa.eu/consumers/odr. Electronic complaints book: livroreclamacoes.pt.

Right of withdrawal — model form

You may withdraw from the contract within 14 days, without giving any reason, by notifying us of your decision (by email to info@jamarket.eu). You may use the following template, although it is not mandatory:
